Apple Launches New Attack on Samsung Phones

Apple seems to have a revolving door for legal actions as of late. Today the Chicago Tribune is reporting Apple has asked a federal court in California to block Samsung from selling its new Galaxy Nexus smartphones, which use Google's newest version of Android, called Ice Cream Sandwich, alleging four patent violations including new features such as a voice-command search function.

Galaxy Nexus, the official debut of which was delayed by Samsung in October to pay respect to Apple's co-founder Steve Jobs, is the first phone running on the newest Android version before the platform is widely adopted by hardware manufacturers such as HTC Corp and Motorola Mobility. HTC and Motorola are also in separate patent disputes with Apple. In a lawsuit filed last week in San Jose, Apple said the Galaxy Nexus infringes on patents underlying features customers expect from Apple products. Those include the ability to unlock phones by sliding an image and to search for information by voice.

"Google cannot deny its undivided responsibility for any infringement findings. A preliminary injunction would not prohibit the sale of a Galaxy nexus just because it's called Galaxy Nexus or looks like one: it's all about which patents it infringes on," said independent patent expert Florian Meuller. "I am absolutely certain that...for the preliminary injunction motion the Galaxy Nexus was singled out because it's so new, and important."

Samsung said in a statement on Monday that it is aware of the filing by Apple in the California court. "We continue to assert our intellectual property rights and defend against Apple's claims to ensure our continued innovation and growth in the mobile communications business," Samsung said in a statement.

With the new lawsuit, Apple is opening up another legal assault on the South Korea-based company after taking Samsung to the same court in April of last year. In the earlier case, Apple alleged that Samsung illegally copied iPhone and iPad design features and the look of its screen icons. That case is still going on, although in December Apple lost a bid for a preliminary bar against Samsung for selling Galaxy phones and tablets.

Apple acknowledged the setback in the new action and said now it is suing over new products and different patents. In addition to the California cases, Apple and Samsung are waging more than 20 legal fights in at least 10 countries in their war for global leadership of smartphone and tablet markets.

The way i see this....Apple are butthurt their pad got banned in china, Samsung threw a small party in celebration as Apple got their Galaxy SII banned in Germany, Apple didnt like being laughed at so has launched a scathing attack on Samsung trying to get their new phone banned

I wasn't refering to their profit's, everyone (with a brain) know's that Apple's marketing dept is like the pied piper. They play the tune and the masse's just eat it up. I was refering to their business tactic's/practices and outlook. I personally feel that competition is a good thing, otherwise we'd all be using the same crap. Aren't there law's against monopolizing? Seem's like this is what Apple is trying to do, monopolize the smartphone market and reap all the profit's themselves.

Want it? Can't have it! Want it? Can't have it! :laugh:

They are no where near a monopoly yet and no matter what the Galaxy brings it will never out sell the iPhone. This suit is a pride issue for Apple. It has nothing to do with what the suit is really about. Jobs basically said he would bankrupt Apple to stop anything Android. Its about him and his pride.

He wasn't a very good Buddhist.

I think Android product's will eventually outsell iPhone, they are constantly getting better and once they have the marketing behind them the sky's the limit! Hell the current Android offering's are better than what Apple has, it's just that marketing dept :pimp:

Regarding monopolizing: They are getting pretty damn close and trying pretty damn hard it seem's, they like to borrow tech/service from other mfg's but get butt hurt when someone has something similar to them. Woosies

theres always a chance of bricking your phone if you root or jailbreak it. most people generally careful and actually know what they are doing before going a head with it.

Oh I love the hypocrisy, what makes a Droid supporter who blindly follows Google any different than an iOS supporter who blindly follows Apple?

If ANYONE is a tech junky and just wants to have the latest tech, then that is the sole basis for which they should be judged, not on whether they are buying an Apple or a Google device this time around. I bought a new ATI card to replace my Nvidia GTX 580, and I'll probably buy what ever Nvidia brings out to compete with the 7900s. Who cares what sticker is in the tech, the fun is in playing with the new toy :laugh:

I recently upgraded my phone, I almost went with an iPhone 4S, but ultimately decided on a Samsung Galaxy S2 partially based on Apple's behavior in using the patent system to attempt to maintain their market share worldwide.

Apple sought to block the Galaxy tablet based on the fact that it has rounded corners. Come on Apple, you can do better than that.
