That's a good thing. I'm sure they will re-consider their illegal warranty practices from now on (we can hope).

I'm sure you'll get the desired outcome here.

Best regards !

Pitty about Novatech. I buy things from them once in a blue moon because they never have what im looking for. Ive bought USB docks & the odd GPU from them (i think it was a 5850) but thats about it.

I heard they themselves havent been doing too great financially hence the closing of some of their brick and mortar stores. I never experienced an RMA with them that was this bad though..... the tech i spoke to on my last RMA with them a few years back seemed to know what he was on about.

Shame.

Yes mine is the dual fan original edition, although to be fair I only paid £179.99 for mine retail 3 weeks ago, mine won't do anything above 1085mhz prolonged under load, she is cool though so I can run her at 1.25V all day at 1150mhz.

Well I have seen some people achieve 1300+ clocks on the R9 280X (Even the 7970) with some of the air cooler models out there (Have a friend running 1275 and I cannot remember memory clock on a pair of 7970's he got with those windforce coolers from gigabyte). I would say 1250 is a pretty standard high point I see with 280X's lately and I can safely say those coolers are top notch so cooling would not be an issue. It would depend on the silicon lottery, but those are normally binned out pretty well that ive seen because of the already hefty clock bump so I would say you should be able to hit it with relative ease.

I would like to thank everyone and the problem is now Solved and Completed.

So I picked up a box from the post office today..... What is in it I wonder.....

I open said box up....

YAY.... a Graphics card, the UFEI Model.

UHOH.... It's been opened :/ Not good in my eyes. Bet those pesky people stole the 3 free games certificate...

Plastic Cellophane on the card, this looks promising, not some referb piece of crap.

No back plate? Hang on a second.... A quick google confirms this.

So I mounted it and now she's all turned on. (it also matches my fans, Woohoo)

Woohoo... All working :)

What GPU voltage is it getting? I have just increased mine slightly by modding my Bios and re-flashing it so she is running cool at 1100/1550.

I don't actually know, there is an issue with GPU-Z only showing part of the sensors.

You can always dump the bios in GPU-Z and then load it into VBE7, open it and it will let you know all the voltage and profiles. Just interested to see if at a default overclock of 1100 if they achieve that through good binned chips or with a voltage hike above 1.2V.

Hey everyone,

I just found this post and was very happy to read that it worked out nicely for Hellfire!
It's a bit long, but I am writing this down in hope that anyone (like me now) in the future will have this as their reference for taking action.

warning - TL;DR.

My issue is similar, so I hope Novatech has learned from this a little and changed their policies on this in the meantime.
I purchased a Sapphire R9 290X Tri-X OC from Novatech UK end of Feb 2014. The card's been running great for 10.5 months.
Unfortunately, one of the three fans went, really annoying bearing noise, especially during system idle.

So, I contacted Sapphire, who kindly redirected me to Novatech as retailer. Thus, I contacted Novatech on 13 Jan 2015, got an RMA 14 Jan 2015, and also sent it to them right away on the 14th.
I took plenty of pictures and 2 videos showing S/N and videos showing the grinding noise with no other fans running in the case.
Novatech got back to me 21 Jan 2015, saying that they noticed the fault as well, and will send it off to their supplier
(i.e. Sapphire I assumed but they did only mention "supplier" in the email, also I myself mentioned Sapphire on the phone to them, but they then did not correct me on that).
ETA for supplier was given at up to 28 days.
Anyway, so far pretty good for an RMA process, I thought. A bit annoying to send off a card for a broken fan, but hey, that stuff can happen.

Now, yesterday 04 Feb 2015 I get a call in the evening from Novatech. Without explaining much what is happening they just said that repair/replacement was not possible, "they" don't [have] them anymore.
(At that point in time I was still assuming Novatech was referring to Sapphire, so I was a little surprised)....

Before I could say much, he was asking if the card has 2 or 3 years of warranty, and then said that almost half of the warranty was already gone, then something with just over 50%,
...partial refund, ...cash, ... no other 290X like it in Stock (they do, Sapphire R9 290X Vapor-X for GBP332) - I was barely listening at that point anymore with upcoming rage....
After that, he said they finish work soon, but i should get in touch with them tomorrow morning. Right.
I don't even know yet if I could get my card back at all... was too verbally run over to ask for it in the 2min phone talk until he had to leave.

more TL;DR.

So, I was worried already about them trying to suggest to me, that my card's pretty much worth some 55% after 11 months out of the 2 years warranty (= useful life in the eyes of Novatech).
I paid GBP 412 for it, so I'd get just around GBP225.

After reading all your comments here, I am pretty confident that I will either get the Sapphire R9 290X Vapor-X, OR they give me enough money back for me to buy the same card elsewhere (Scan GBP354 for example), OR I will take them to small claims court.
I was so angry after that phone call. Not even did he let me say anything really. He was immediately trying to get me to agree on the 55% cash partial refund and be done with it.

I also read a bit further into EU/UK consumer rights this evening. Apparently the expected useful life of a item/good can be up to 6 years in the UK.
Basically, if a 'reasonable person' expects a good to 'reasonably' last for 5 years, but the good has only 1 year warranty, the consumer can still claim after that 1 year is passed, if that the good had broken (excluding regular wear and tear), that the good was not fit for purpose and expected useful life from the beginning.
From my point of view, I do think that a R9 290X has a useful life of 3-5 years. Some high(er) end cards from 2010/2011 are surely still run (such as GTX 580, 7950 or as Hellfire's 7970/280X... There is absolutely no reason in assuming that a 2 year old high-end card is useless after it's warranty period of 2 years.

I find it ridiculous that a serious retailer implied that warranty EQUALS useful expected life.
That would imply that ANYTHING with a warranty of 1 year should by default become unusable after 1 year, or worthless.... (although EU is minimum 2yrs anyway no matter what...).
Washing machine 1 year warranty = 1 year life? TV 1 year warranty = 1 year life? Certainly not. Of course stuff like that happens, thus the EU 2yrs regulation, and the Sales of Goods Act 6yrs for the UK.
I read elsewhere that consumers at least got reasonable repair for goods like above after warranty had expired, and when that "reasonable person" could expect the items to last longer than the warranty period.
Sure, we are not talking about some 5GBP item that gives up after 5 years (out of the 6 years possible by Sales of Goods Act) - in that case I would strongly assume 'you' are unreasonable to ask for repair/replacement.

Bottom line, I am quite sure my card has a useful life of 4-5years. My card is still retailing for above GBP300 (GBP350 at Scan for example). Novatech has a Sapphire R9 290X Vapor-X in stock for GBP332, which has the same board and a slightly different but well-comparable cooler.
I will ask them to get that card (or a 980 if they like... haha, and idk about a 3.5GB 970...) and will post back here tomorrow with the result.
I refer also to the post here: http://www.tomshardware.co.uk/forum/130-40-year-warranty-rights
and the article here: http://whatconsumer.co.uk/how-long-should-it-last/#axzz3Qoq8we3M
I rather spend GBP25 on small claims court than getting dealt with by Novatech this way.

Best, k

Hey Bud,

Read it all and yes sounds like the same issue I had.

Firstly, Please note: Novatech's suppliers are NOT sapphire, they use a third party distribution company as they don't do enough volume to order direct from Sapphire. (I found this out with my card)

Sapphire Sells to Distribution
Distrubution Sells to Novatech

Regarding the card, Stand your ground, YOU WILL WIN... please feel free to adapt and use the letter I sent them.

Dear Sir/Madam

I am writing regard RMA number RRXXXXXXX. I was recently made aware after a phone call with one of your engineers that your solution to this RMA is to issue a “partial refund, based on having 18 months usage on a 24 month warranty”.

I appreciate this issue has been escalated and investigated as I have posted about it on your Facebook. However I feel obligated to write to you to address my concerns and to inform you of my stance on the issue.

Firstly, I believe the warranty issued by Sapphire and the law set out by Consumer Rights Act state that I am entitled following and you’re required to offer to:

1. Fix the product to the original functioning specification ensuring it lasts for the remainder of the warranty period.

2. Replace the product with a replacement identical product

3. Or if an identical product is not available a product must be issued with similar performance to the original item.

I was kindly informed the following that:

1. My item is not able to be repaired.

2. Replacement product is unavailable

Instead, I was offered a refund of the Value of around £70.00 Plus VAT, so a total of £84.00. The equivalent product to my item is currently on sale, with you for £239. Factoring in the costs of replacement products you are offering me 35% of the cost of replacing the product.

I would urge you that offering a partial refund of this is against the warranty that Sapphire set out and I must note I will be forwarding these concerns to Sapphire Tech directly.

As for the third Item, a product must be issued with similar performance to the original item. I must inform you, as apparently your “Engineer” has no knowledge that the Sapphire R9 280X Vapor X, a product in which you hold in stock is an identical replacement, So much so that it is just a rebranded Sapphire 7970 Vapor X, shares the same components and performance. This would of course fit the criteria of point 3 above.

To summarise my complaint I request that you either fulfil either one of Steps 1-3.

In addition to my complaint above, I wish for you to set out your standard operating procedure for returns where replacement products are not identical and for you to confirm in fact, the offer of refund based on usage is in fact in line with this.

I eagerly await your resolution in the matter

Regards

Graeme Nicholson

Also, kick up on their facebook, neg PR hurts retailers like these a lot ;)

This worked amazingly for me and they were quick to change their stance, (they continue to do this as so many people will keep accepting their SOP.

Since this has happened again I MAY have a word with TS as their actions are not correct and fall fowl of many consumer regulations.

Need any help feel free to drop me a message.
