GTX 970 Ebuyer RMA not going smoothly: advice?

I don't know if anyone on the forum's had this problem as well with the MSI 4G GTX 970. Whenever I apply a 3D load the second fan would get stuck at 100% and the first fan would struggle to spin up. I created a video showing the problem to send to Ebuyer (I've had to send the card back three times now)


Ebuyer refused to replace or refund me and keep testing it. They've now sent it to MSI in Netherlands.

As this is a hardware defect which is known by MSI I'm entitled to a replacement or refund right? I sent the card to ebuyer in under 6 months. I also told them I had the problem after gaming but their technicians tested for the fault using furmark. Their notes below:

18th March 2015 – Technician 1
The card was tested for 3 hours with Furmark to get the temperature to rise. Once the temperature got to 63 degrees both fans kicked in, then left it to run for about 30 minutes. Stopped the program to allow the card to cool down.
I then repeated this for the next further 3 hours and both fans worked fine throughout.

30th April 2015 – Various times throughout the day – Technician 2
Both fans are running fine, no push or anything else needed it just works. Both fans kick in as soon as the temperature gets to 63 degrees as designed.
The card has been running fine and both fans have been running using open hardware monitor to monitor, the fan speeds that are rarely above 50 percent while running Furmark at full settings. Both are running within 5 percent of each other.
Have rebooted Windows several times and ran Furmark in-between, as soon as card gets to 63 degrees both fans fire up no problem at all.

I didn't have any problems with the card running Furmark either FWIW

I bought this card early, on the 26th of September. I've read this was a problem with the early batches, however I was prompted about any GPU bios updates, so I hadn't done any before I sent it off

That video makes it pretty clear. Did you offer the video to Ebuyer yet? If it's been sent to MSI now, it's back out of your control. You'll have to wait. To be fair, Ebuyer may have tested it and not had the results you get, for whatever reason. Keep us updated but I'd recommend that the thread not be derailed by RMA "shit company rants".

I've tried but I can't find their email! I barely have enough minutes to call ebuyer let alone international numbers! I tried tweeting at the American MSI account to get details for the EU department but no luck!

Yes I sent the video to ebuyer. They didn't send it to MSI until I did!

I totally agree, ebuyer have been terrible but I'm not going to get into that right now. Ebuyer haven't tested it by playing games, they've just stuck furmark on. They haven't tried to replicate my conditions. I get the problem playing Age of Empires 2 HD, which isn't as demanding as Furmark. I think I know what my statutory rights and I'm entitled to a replacement or refund as I reported the problem within 6 months of the purchase date

You're perfectly right in saying your card is faulty. Your video clearly shows the fan trying to start, but not quite being able to - those fans should be working together, not one on one off. This is either a fault with the fan itself or the drive circuitry and Ebuyer should just replace the card. You're also right that Ebuyer should test it in the same way that you did. NVIDIA is known for intercepting stress test programs like Furmark and treating them differently, so it may well be hiding the issue, which is why they insist on only running that and not testing like you did. Or likely they did test like you did and are just lying.

So, did you buy it on a credit card? If you did, then you can claim against the credit card under section 75 of the consumer credit act. Give them a call and make that claim, you'll be glad you did. The fact that Ebuyer claim to have sent the card off to MSI won't adversely prejudice your case, especially when you get it back still faulty or don't get a card at all.

Yes I meant to post earlier saying I paid with a credit card. I applied for specifically for building my PC as it consists of high value parts. I will look into a charge back if I can't get my card back in a working order or replacement

If you have no luck, could you not just use MSI's Afterburner and just override the fan profile ?.

Other wise good luck.
I tried it on afterburner but no luck. Also the luxury of having the fans completely off is something I can't go back from (nor should I have to as that's the way the card was designed)

If you have no luck, could you not just use MSI's Afterburner and just override the fan profile ?.

Other wise good luck.
The card has got hardware failure so no utility is gonna help.

It sounds like it's the same card going back and forth. It's clear Ebuyer don't actually have any intention of fixing the problem and hope he just eventually gives up, so they've got his money and he doesn't have a working card. Those bastards should be out of business. If that sounds a bit strong, it's because I'm talking from experience. They will actually break the law if they think they can deny you something and get away with it. :shadedshu: Steer clear.

Yeah this is a company that rates their staff on returns rejected so shit like this is not in the least bit unbelievable.

It sounds like it's the same card going back and forth. It's clear Ebuyer don't actually have any intention of fixing the problem and hope he just eventually gives up, so they've got his money and he doesn't have a working card. Those bastards should be out of business. If that sounds a bit strong, it's because I'm talking from experience. They will actually break the law if they think they can deny you something and get away with it. :shadedshu: Steer clear.

You're right, I spoke to a guy on the phone and told him as I reported the fault within 6 months the onus is on ebuyer to prove they didn't sell a faulty product but he told me I was wrong, even though it's my statutory right. I spoke to the supervisor who then told me I was right and the previous guy had it wrong...

And yeah it's been the same card sent back three times. Sucks

Yeah I'm waiting to see what MSI have to say about it. If they do a replacement then it's all good, but I'd have gone about 30+ days without my card. If they replace that'd be an admission of a hardware fault and I feel I should be compensated by ebuyer for my downtime!
