didnt they verify or rather solidify openGL 4.0 specifications? why does nvidias new cards only support 2.1?

Nope HD4xxx is 2.1 too. There's still no 3.0 cards out, and after seing how dissapointing the 3.0 has been for many experts (to the point of calling it OpenGL 2.2) I have my doubts they will be in a rush to support it.
