I would prefer to have the seller anticipate the fees by including it in his asking price. As erocker said, list it for $42 instead of $40. I would much rather see that than see someone asking for a gift payment.

if its done by gift, you cant get your money back should the seller be dodgy.

simple as that.

as hat says, the buyer should include it in the price if they're that worried about it.

no I busted him for selling a friends goods, that he didnt have possetion of, now he wants a rewrite so he can have another loophole.

The rules are very clear. Besides, why does someone need someone else to sell on a forum? Sign up, wait 14 days and sell it. If you can't wait 14 days, use Craigslist or ebay or something. We don't change the rules just because it's convenient for someone be it a "staff" member or otherwise.

It is stated in the rules that you must have physical possesion of all items.

While you may make the argument you're selling it for a friend, the same excuse can be used to sell something you intend to buy off someone after you get paid - acting as a middleman and only purchasing the product for yourself AFTER you get a buyer at a higher price.

thats why moderator decisions are final, and above that of the rules. unlike a legal system, you cant say 'its allowed because the rules dont say otherwise'

we have no rules against human organ trafficking, yet if someone tried selling their left testicle, it wouldnt be allowed even if they met all other rules.

So it is ok to sell my friend's stuff, as long as he gives it to me first? Technically, I would then have possession of the items, even if I was giving the money to him after the sale.(Really, why would you care where the money goes after the sale?)

I mean, if I can take pictures of the actual item, doesn't that prove that I have it in my possession?

I mean, it seems like the easy solution is to just not say it is your friend's stuff. I know that is what I would do. I'm selling it, It's mine, end of story.

OEM Windows is legal to sell on its own, as long as it hasn't been installed on any other computer before, and the package hasn't been opened. Once a person opens the package, they have to distribute/sell it with hardware.

That is how all the major e-tailers are allowed to sell them alone.

If my friends want to sell something on TPU, i find it easier to get them to post the item, and me say "honest seller, i've seen the item myself and can verify its condition" - easier on everybody.

as for your edit above: they buy it with hardware, and they're supposed to sell it with hardware. Here in AU many stores sell them in a dubious fashion, but they require hardware to be sold with it. Unlike those stores however, TPU is responsible here for allowing illegal sales - not you. We simply cannot condone a sale for an item with such big letters that scream "THIS IS ILLEGAL"

so items that were received on a review basis technically belong to the site they were reviewed on so cannot be sold here on TPU because that would be selling other people stuff?

Sell the OS with a stick of RAM or other 'hardware' and it wont be illegal.


I have two sticks of DDR2 (256mb ) for this purpose, when I come to sell some software I'll bundle them with it and off I go.

you are taking it too far fits......

TPU review hardware has been and is currently being sold

if you have possetion and if qeuwstioned can prove it, I see no issue with selling a friends goods.
In fits case I asked for proof as it wasnt his photobucket, not his handwriting on the paper either. I asked for more proof, he couldnt produce it, thread closed.

thats how stores do it around here, but thats not to say its allowed here on TPU.

its a very simple matter: mods decided an item could not be sold here on TPU. thats it. he can sell it elsewhere, he didnt get an infraction, etc.

That's like saying I cant sell a 300w Bestec PSU on here because it may (will) blow up when used with any rig.

I could sell it on here but doing so would in my view, be a bad idea....but there is no rule saying I cant sell such a bad PSU.


If it doesn't break any rules, forum, international or other...let it be sold.

Ya'll know possession and ownership are to different things, right?

I currently have an HD5970 in my main rig(yeah I really do), it is in my possession. However, my work actually owns it(I need to bring it back today). Of course, I wouldn't sell it because that would be the end of my job, and I like my job. However, according to the rules, I would be allowed to sell it here.

Just do the right thing. The mods are here to make sure that happens, and sometimes the line is a little fuzzy so they need to make a decision. If every possible situation was covered in the rules the first post would be a mile long.
