just found this on ebay. Personally failure on cold boot suggests a psu issue not a gfx card issue. Quote:

A hardware crash would black screen to a dead system with a total shutdown, Powerless goes into safe gpu cool down. Also i believe asus offer 3 year warranty on GPU's. A few minutes on the phone with them i could get an rma. It'd be pretty easy to say i got the card for my birthday from my grandmother who recently passed away so i have no access to a receipt. Sounds to me like possibly the sellers PCI-E slot is having a hard time initializing on his motherboard.
