New Jersey Man Gets Two Years Jail for AOL Spam e-mails
A New Jersey man was sentenced to more than two years in prison on Friday for helping send "spam" e-mails to more than 1.2 million America Online subscribers. Todd Moeller, 28, was sentenced 27 months in prison in a federal court in New York after he was caught making a deal with a government informant to send junk e-mails -- known as spam -- advertising a computer security program in return for 50 percent of the profits, the U.S. Attorney's Office in Manhattan said. Moeller told the informant via instant messaging he could conceal the source of the e-mails through his access to 40 different servers and had profited $40,000 a month from other spam e-mail scams that promoted stocks, prosecutors said.

While I do not like spam or spammers, it is a hypocritical of the US to jail them.
The only difference between e-mail and snail-mail spam is that when you get snail-mail spam the government gets a piece of the action in the form of postage costs. I think that if they wanted to be fair about it they should fine the e-mail spammers the current postage rate times the number of e-mail spam letters they estimate he sent. So, current bulk postage is about a quater I think, so $0.25 x a jillion. I think paying a quarter jillion dollars would slow down the spam a bit

I don't get junk mail. I went to my local post office and arrange not to get any. It wasn't really hard. When I showed up with boxes and boxes of junk mail from one year and left it with them. Never got it again. You should have the choice to receive it or not to.
It should be set up like the no call list.

I never got a call after I signed up on the no call list. But that expired. Theres a new one coming out.

They really should of taken all his assets just like they do to drug dealers.. this guys no better really, he knew what he was doing.. stealing peoples earned $$$.
He'lll prob be out in 6-8 months maybe less on good behavior and have all that money he stole waiting for him. Not sure how the corrections services work down there in the states though... here you get 2 years.. you can get out alot earlier.

Yeah I just thought about it.
Why is he still allowed to use a computer. I know of hackers who have been banned from using computers for like 5-10 years for their activities, why is this any different? |

Well at least it is a US Federal sentence, so he will likely serve most of it. His name will pop up readily on any future criminal background check. (Doesn't always happen with State convictions) but I think it should have been twice as long and a big fine and cut off from computers for the time he is in prison and ten years after release. I think that would fit the crime better.
I have had good luck with the 'no call list' by the way except for those 'Charitable" and political calls and research surveys.

i have recenty come to the conclusion that the only reason the riaa is so against piracy is because they can afford all these programs and music with their rediculous govt salery shove them in a grocery store working 9-5 @ 8 $/hr format their computer than see what happens
