Perhaps just a defective GPU, or you are askign too much of the system.

3DMark06 score was exactly on par with what I was expecting so I doubt its a faulty gpu. I'd say your right thinking he is expecting to much of it.

If I change my GPU to a GTX 260, HD 4870 will I see a significantly better frame rate at my res or will my CPU bottleneck it?

Looking more at your spces, it is possible that in single threaded applications the CPU is holding you back form getting the most from your GPU. Overclock it and try again.

CPU is overclocked at 3.0...stability issues if pushed any further with the stock cooler. Current residing very nicely at 1.3v.

If you lower the game settings at all does it help or does it still stutter?

Well I've altered my ram timings as checking it with Memtest brought up errors. I've now run a few passes with the new timings and not one error. The best news is that the stutter has been eliminated and now ALL games work very smoothly obviously allowing for the 9800GT's performance. Will soon be getting an HD 4870 1Gig , 4 GB of 1066 ram and a 1920 x 1200 monitor. Lets hope it goes well...thanks to everyone for their suggestions
