Californian Gamer Starts Class-Action Lawsuit Against Microsoft over Halo 3 Errors

    Microsoft and Bungie have received both good and bad press from Halo 3. On the one hand, they claim record sales and profits. On the other, a sizable portion of the disks were faulty anyways. Thanks to a trivial packaging mistake, most of the "Legendary edition" disks came loose and scratched themselves during shipping. Even when the Halo 3 disks arrived in one piece, there was a certain chance that the game would not even load correctly, which Microsoft was well aware of. This inability to load correctly causes Xbox360s to "crash, freeze or lock up". That's the case that Californian gamer Randy Nunez is making against Microsoft. His class-action lawsuit seeks $5 million USD, and claims that Microsoft should have recalled Halo 3 after they knew about the crashing, freezing, and locking-up that Halo 3 would cause. What could really win this case in favor of Nunez is the fact that quite a few gamers get disk read error messages in the middle of a Halo 3 battle.

    M$ only has themselves to blame for not offering a straight recall for a problem they caused, you would think after the 1:3 failure rate problem M$ would do everything in their power to limit reliability issues regarding the xbox brand.

    Sue them for $5m? Where did he get that figure from?

    The most powerful thing he can do is to not buy the game, or anything else from MS.

    Honestly, no, he isnt off his rocker. He has a legitimate shot to get something out of MS. Certainly no $5,000,000 USD but something for this. If it turns into class action (20 or more plantiffs) it wont matter, MS will settle to avoid bad press.

    What a douche bag!! Unless your faulty disc caused any hardware failure (actual broken hardware, not a reboot or lockup) or financial loss due to crashes and down time what the hell makes him think MS owes him any money??? I don't love microsoft by any means but I really dislike stupid people.

    Why should he?

    What basis does he have for this claim?

    He bought a product, it was faulty and he had an exchange or refund.

    I fail to see how the company owes him 5 million dollars

    Maybe they will settle to avoid bad press, but that makes a total joke out of your/our society. Even if he only gets 1% of his claim, that is 50,000, which would take most people years and years to save up. But instead it's more profitable to think of a petty lawsuit.

    Most of the judges are to blame as well because they are stupid enough to rule in favor of the plaintiff and then they walk away with the ridiculous amount of money that they are suing for.

    So, did anyone have any luck suing Sony for scratched discs? If you were lucky, they'd replace a disc IF it was from SCEA, and sometimes they wouldn't budge, even if you claimed the faulty disc damaged your console.

    Why would Microsoft be any difference.

    I hardly see this creating 'bad press.'

    LMAO Reven, even if he did win everyone will just call him a little bitch anyway. HE will be demoralised for the rest of his life, I don't think he needs to be mugged. Would be humorous if he won the whole amount he is chasing, then was posting a youtube video of him showing off his new Microsoft bought house (what else do you need 5 million for? Crack?) and he fell down his granite stairs because he tripped over his Xbox 360.

    :roll: that makes no sense. Btu then again, neither does bitching about a scratched CD.

    Waterfront house.
    A massive room with space for 50 computers, sexy lan and party facilities.
    Digital networking in everything from the doors, windows, fridges, alarms, cameras etc.
    A big block dodge, shelby, or ford. OOOOh and Ive always wanted a flamethrower exhaust kit.

    Then id need to save up and buy a luxury boat.
