I need to sue someone soon.

    I need to make a case in small claims soon for a sum of money I lent out in January to be paid out by the end of the month. The contract was verbal, but the day after lending the money the recipient refused to answer contact by phone etc. I've waited up until this point, but I'm strongly leaning towards legal action. Anyone have advice?

    its hard to win in court because it was a verbal contract. however if you have any witnesses or people who witnessed the transaction this will help in court. however getting your money back will be hard going through the right way.

    Explicit verbal contracts are to be honored as written. It is law in Pennsylvania. If you can't be constructive I'd appreciate it if you didn't post.

    You raise a point that people have asked me a few times, but it is worth it on principle. Nobody rips me off, especially locally.

    well that's all well and good but if he just goes and kicks ass, he's bound to get legal action directed at him himself then he has an even larger problem on his hands.

    Talk to his parents. It's relay-asskicking. Ok jokes over, but vistiting him personally and tell him your plan. Maybe he'll lean into talking to you. If he laughs in your face, sue him. Maybe have a voice recorder running when you talk to him. If he says he won't pay you back, and you have that on tape, he's screwed in court.

    Best idea MCRL, that will do better than even a witness. It's not enough money to be out of small claims court guys, keep that in mind.

    Becareful Binge, cause I beleive to withstand in court, use of a personal recording device in Pennsylvania to obtain evidence has to be consented by both parties.

    But can it be considered suspicios if the one being sued does not consent? I mean if he was innocent, he had nothing to fear that is on tape. Dunno if that works in the US tho, you have a crazy legal system over there.

    It falls under the wiretap law in PA. The evidence can be thrown out of court upon objection by the defendant's attorney.

    Hire someone to do the asskickery lol. Honestly, you will probably win in court, but then he will just stiff you anyway and you will have the court costs too. I would just put some sugar in his gas tank and be done with it. Maybe take the valve stems out of all his tires.

    If the amount is equal to or less than $2000, it goes to small claims court. If the amount is greater than that, you'll need a full blown court case.

    You'll have to decide if it is worth getting a lawyer or not too.

    It's amazing how quickly people pay up when their teeth or knee caps are at stake.

    That being said, the only time I've used this kind of service was when tennants refused to pay rent and also refused to get out of my house.

    So you pick up the phone, give these guys the details and with in 2 hours either you have the outstanding money or a promise that the tennants will be out by the next week.

    In my case, they were out at the end of the same week :D

    Cost me less than going to a lawyer or court, which is a huge waste of time in this country.

    Generally, strong arming just gets the person who is strong arming into trouble, at least in the adult, civilized world. Since you live in a small town though, I do think embarrassment may be your best tool. Word gets around FAST in small towns. As suggested above, I'd talk to parents, common friends/acquiantances and maybe their girlfriend. If for some reason this does not work, and considering that you have witnesses, then small claims is your best options. I'd certainly sue for court fees too. Good luck. I've been in a similar situation. Thankfully the threat of embarrassment eventually worked.
