We all remember the big fiasco that went on right before Win7's release about some Intel processor not supporting XP Mode due to the lack of VT support.

Intel obviously got wind of the disappointment, because the new Celeron E3000 series processor did support VT. However, the already existing E5000 series did not. It was kind of odd, seeing a lower processor support features that it's higher brothers did not.

Well it seems Intel was not oblivious to this as they have, rather silently, release a new version of the E5300 and E5400 that now support VT.

I wonder if people with the older E5300 and E5400 processor would RMA for one of the newer with VT? Would that be an acceptable reason to RMA?

Yes, it would be acceptable. If Intel wants to change that, they should release the product with a different model #...
