Question on monitor refresh rates and games

I have been researching monitor refresh rates a bit ever since I got this Qnix and have it OC to 96hz. In Battlefield 4 it seems to help A LOT, and don't notice screen tearing and all that nearly as much unless im pulling 100fps in certain spots. However, in some games like Batman Arkham Origins or Crysis 1, still after 60fps ill get tearing and all that, even with the screen refresh rate at 96hz.

I noticed in Assetto Corsa that in the resolution selection options there was two 1440p options. One at the basic 60hz, and one at the overclocked setting 96hz. In other games like Batman, or Battlefield it seems that refresh rate setting is defaulted at like 59.x, is this why in those games ill notice screen tearing a little bit still? Because the game setting overrides what is set in the Nvidia Control Panel?

Or even with higher fresh rates tearing is still possible? and ill need something like G-Sync or FreeSync to completely get rid of it once and for all?

EDIT: Just checked Battlefield 4 again to see if there was the option for 96hz like in Assetto Corsa, and there was, just had to go one more to the right to get the 2560 x 1440 96hz option. Seems you can do anything about it in Batman Arkham Origins.
