    Hmm the ES board is owned by AMD and on loan to someone. This person probably passed it on to the eBay seller, which still makes it AMD property. So technically it's stolen property?

    Shouldn't be different than buying an iPhone off craiglist

    AMD told me the card can be sold. They actually looked at the listing on Ebay while on the phone with me.

    The person is able to sell that card and not get in any trouble for doing so.

    AMD told you that? Who from AMD? I have never seen a company break their OWN NDA... seriously... I call shens on that shiz!

    EDIT: Saw your edit.. a customer service rep likely hasnt a clue of that card, or its NDA date or anything. B O L O G N A. LOL!

    The iphone that is being sold isnt a pre release, under NDA sample in your example, right?

    I dont know, I wouldnt do it.. but then again we are a small website compared to here so burning bridges isnt something we can afford to do! :laugh:

    NDA is just a contract between two parties, if you didn't sign it, it doesn't apply to you.

    We dont know if the seller is 3rd party or not.. a lot of assumptions.

    Who knows... doubtful. Plenty of ES CPUs being sold that shouldnt be sold. So really no clue on if/when that may/may not get pulled.

    Question is when will they surface in stores?

    Bidding is up to $890, ~5 days to go.. It'll reach $4,000 my guess and right before the bid closes, Newegg will have it listed for $1200, lol

    If you look at the bid history, it's a whole lot of people with low feedback and with zero feedback. My guess the winning bidder won't pay.

    If you know the right people on Facebook, the reason the price is stuck there is that eBay requires special contact to be made to bid $100,000. I guess the joke bids stop here!
