A CALIFORNIA woman has set a precedent after a court ruled that she was entitled to damages over the installation of Windows 10 on her machine.

Teri Goldstein, a travel agent, testified that the new operating system had auto-downloaded, started to install, failed, and left her Windows 7 computer running painfully slowly and often unusable for days.

"I had never heard of Windows 10," Goldstein told reporters. "Nobody ever asked me if I wanted to update."

Microsoft's support staff couldn't identify the problem, so she sued for lost wages and the cost of a new computer.

Goldstein won, and has become the first Updategate victim as far as we know to get some cash out of the company.

im sure its obvious and im just missing it, but why the Fu@k does M$ want all PC's updated SO bad?
surely its not for uniformity, or simplifying theyre support work load, since they could just stop updating win7.

it just feels REALLY "alterior motive" 'ish

She won in Small Claims Court, meaning that she hasn't set precedence for anything. Small Claims Court is the judicial version of Judge Judy, it's all left to the judge's discretion and won't convince another judge to make the same decision. Unless Microsoft runs in to a massive Class Action Suit, they'll just ignore this settlement.

Take a look at all the spyware-esque shit in W10. Your PC phones home every time you take a shit. I believe that probably has a lot to do with it. I also feel there's something fishy going on with the forced updates. At least as far back as XP had automatic updates, that wasn't good enough? Windows update is not only forcing you to install updates but it's also very intrusive about it. Sure, there are workarounds, but that's not the point.

Its Still a precedent she won while it may not be a Legally Binding Precedent for other court cases SHE STILL WON $10,000 from Microsoft and $90

yup, i installed program that makes windows notify me when updates are available, then it ASKS me IF i WANT to Download them...seems silly for me to take pleasure in Choice, and the power to make it on my own, but thats sort of illustrates the problem @ hand tho doesnt it?the fact that im concious of my freedom of choice, tells me its being threatened

Kind of makes you wonder why they would want to , err, forcefully force updates rather than the standard automatic updates that's been present at least since XP (maybe earlier, my knowledge does not go back that far).

One would think huge corporation like Microsoft with almost unlimited resources would know better. Why forcing users to update instead of just giving them a reason to update? If Windows 10 wasn't such nightmare with forced installations and tons of privacy issues with data mining, people themselves would install it the first day of release. Instead they are resisting exactly the same way they did with Vista. People were talking how bad it is and everyone avoided it even though it was actually perfectly decent OS. Exactly the same is with Windows 10.

I get it, they want to eliminate old Windows versions and only deal with latest one, but you won't win any hearts by forcing it on users with fury almost. I mean, it's free and people don't want it. Doesn't that tell them something? Now, the OS has few really dumb design decisions, but once you hack those, it's a really nice OS to use. Sort that shit out (inlcuding PR afterwards) Microsoft and people will want it. But hey, what do I know...

i understand that, but upgrading to win10 with a pirated /OEM/"abused, and overused" windows key is as easy as running 7.pirated,etc... if anything, it legitimizes the questionable ones, but iirc, win10 is "subscription" based, isnt it? so people need to pay yearly or something to that effect....or am i mistaken, i cant remember where i read/heard that.

No, Windows 10 is NOT subscription based. And the day they'll make Windows subscription based, no matter how hard they'll try, people will refuse to use it. You can have outdated/non functional antivirus (though not recommended) or Office package. You can't just block users from using core system software because they don't want to pay yearly for it. Same reason why many people still run Windows XP. Because they don't need anything more for their rubbish Pentium 4 PC from 15 years ago. If it was subscription based, they'd be forced to install WIndows 10. Which would be a no go scenario.
