Official Rules for the Dell Online Performance Shootout Contest
NO PURCHASE NECESSARY. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING. THE FOLLOWING CONTEST IS INTENDED FOR THE UNITED STATES ONLY AND SHALL ONLY BE CONSTRUED AND EVALUATED ACCORDING TO UNITED STATES LAW. DO NOT PARTICIPATE IN THIS CONTEST IF YOU ARE NOT A UNITED STATES RESIDENT.

Dell's Online Performance Shootout Contest (the "Contest") is open only to legal residents of the fifty (50) United States (including Washington, D.C.), who are at least thirteen (13) years old at the time of entry and who have a valid email address. Void where prohibited. Employees, officers and representatives of Dell Marketing L.P. ("Sponsor"), Futuremark Corporation ("Futuremark") and their subsidiaries and affiliated companies, and their immediate families and those living in their households, are not eligible. The Contest is subject to all applicable federal, state and local laws and regulations. Participation in the Contest constitutes entrant's full and unconditional agreement to these Official Rules and Sponsor's decisions, which are final and binding in all matters related to the Contest.
Between [12 AM EST] January 10th, 2007 and [12 AM EST ] am February 10th, 2007 ("Promotional Period") prospective entrants should go to http://www.dellcommunity.com/Gaming and follow the links to the Dell Online Performance Shootout or go directly to http://www.futuremark.com/community/competitions/dellfmperformanceshootout/. At this site an entrant shall review and accept all terms and conditions of the contest upon which they may follow the rules for participation in the Dell Online Performance Shootout. Scores will be submitted to Futuremark. The leading scores will be posted to http://dellcommunity.com/Gaming. Please allow 24-36 hours to reflect the most up to date information. By entering the Online Performance Shootout a contestant is automatically entered in the Online Performance Shootout Giveaway.
Install Futuremark's 3DMark06 performance benchmark software Version 1.1.0 ("Software") on your computer when prompted (if you do not already have it). Installation is free. The Software requires DirectX® 9.0c and a graphics card that is Shader Model 3.0 compliant pre-loaded on the entrant's system in order to enter the Contest and Giveaway. Actual configuration of entrant's system is user defined. The basic (free) version of Software is the minimal requirement. Advanced or Professional versions are allowed but will not increase or otherwise affect the performance of the benchmark. Advanced or Professional versions of the benchmark settings should be set to default to match those of the basic version. Software will be run in default settings and in accordance to the testing procedures set forth by Futuremark during installation of the Software. Your settings may be changed in order to run the performance benchmark test. Any settings used before the performance benchmarking will be lost. Sponsor and its agencies shall not be liable for lost data on the entrant's system or any other damage to, modifications of or interference with, entrant's computer or system. If you are using your Parent's computer, you should get their permission for these changes in settings.
Download the software and install. By installing 3DMark06 a contestant agrees to all rules and procedures set forth by Furturemark. Run the Software, and report the score to Futuremark through their Online Resultbrowser (ORB). If a contestant has not already registered in Futuremarks ORB, go ahead and register. Once registered, a contestant should rename the project to "dellperformanceshootout". The performance benchmark testing scores will be submitted to a Futuremark representative and then reported back to Sponsor. Sponsor will post the current top 10 scores every day throughout the duration of the Contest. Please allow 24 to 36 hours before checking the leaderboard on http://dellcommunity.com/Gaming.
One grand prize winner, one second place winner and one third place winner will be selected based on a determination of the system with the highest scores among all entrants on the performance benchmark testing during the Promotional Period. In the event of a tie for the final score, the winner will be determined by a random drawing among tie scoring entrants. The winners will be publicly announced on February 11th, 2007 on http://dellcommunity.com/Gaming. Winners do not have to be present to win. Entrants will be notified by email or phone if they are potential winners of the Contest and will be provided directions for validation. All potential winners are subject to verification before any prize will be awarded. Use of any automated system in violation of these Official Rules to participate is prohibited. Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible or misdirected registrations, which will be disqualified. In the event of a dispute as to any entrant, the authorized account holder of the email address used to register will be deemed to be the entrant. The "authorized account holder" is the natural person assigned an email address the organization responsible for assigning email addresses for the domain associated with the submitted address. Potential winners may be required to show proof of being the authorized account holder.
ALL POTENTIAL WINNING ENTRANTS ARE SUBJECT TO VERIFICATION BY SPONSOR AND FUTUREMARK, WHOSE DECISIONS ARE FINAL AND BINDING. AN ENTRANT IS NOT A WINNER OF ANY PRIZE, EVEN IF THE CONTEST SHOULD SO INDICATE, UNLESS ENTRANT'S ELIGIBILITY AND THE POTENTIAL WINNING SCORE HAS BEEN VERIFIED AND ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE.
All selected potential winners must comply with all terms and conditions of these Official Rules. Sponsor's decisions as to the administration of the Contest and the selection of potential winners are final and binding in all matters related to the Contest. Each potential winner will be required to sign and return to Sponsor, within fourteen (14) days of the date notice is sent, an affidavit of eligibility and liability/publicity release in order to claim the prize, as well as fulfill any such other requirements as determined by Sponsor. If any potential winner cannot fulfill Sponsor's requirements the potential winner forfeits the prize. In the event that a potential winner of any prize is disqualified for any reason, Sponsor will award the applicable prize to the next best scorer among all remaining eligible entries. If winner is a minor, prize will be awarded in the name of parent or legal guardian, who must sign all documentation on behalf of minor and him/herself.
The grand prize winner will receive a Dell 30" widescreen LCD monitor with an estimated retail value of $1,275.00. The 2nd place winner will receive a Dell 27" widescreen LCD monitor with an estimated retail value of $999.00. The 3rd place winner will receive a Dell 24" widescreen LCD monitor with an estimated retail value of $720.00. Total estimated retail value of these prizes is $2,994.00. In case of a tie, duplicate prizes will be awarded. No cash or other substitution, assignment or transfer of any prizes is permitted, except by Sponsor, who reserves the right to substitute a prize or prize component with cash or another prize of comparable or greater value. Winner is responsible for all federal, state and local taxes and fees associated with prize receipt and/or use.
Sponsor reserves the right to cancel or modify the Contest if fraud, technical failures or any other factor beyond Sponsor's reasonable control impairs the integrity of the Contest, as determined by Sponsor in its sole discretion. In such event, Sponsor reserves the right to award the prizes at random from among the eligible entries received up to cancellation. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner.
