Must be a driver issue.

I am at a loss here.
Are you using this drive connected to the motherboard in you specs?
Or, is it a different MB or an add-on card?

The reason I ask this is... Your MB in the Specs uses a AMD SB850 chipset, not an Intel south bridge (Which is required by Intel's RST).
You may wish to try the AMD South Bridge and AHCI for Windows 7 and/or the SB8xx RAID Driver for Windows 7: 64 bit link to the software

Some of the firmware updates state(d) that it will not work with Intel's RST, however, I have never had any problem.
However the newer updates for the Vertex 3 states:

So, you would need an alternate method to flash the firmware.

And, you are connecting the drive to the (should be blue, not white) SATA3 1-6 ports?
AHCI is enabled in the bios?
Using the latest bios for the MB?

BAH... you are correct, im not using an intel chipset...

( my last mobo had it )....

well then i guess i will have to try update it from another PC as it does not show up with the tool,

i have it set to raid, but it should use AHCI for non raid drives... i also tried the white slots set to ahci but that was a no no.
cant boot windows without it in raid mode...
