I get today my Asus RTX 3070 TUF Gaming OC with the Bios 94.04.25.80.F0 and its from September 2020. On the Asus Homepage there is a new Bios from December 2020 but i can not flash. On TechpowerUP the latest have the version 94.04.3A.40.2B and its from November 2020. Why i can not flash the new Bios?

First thing first:

Why would you want to flash your card to begin with?

And a friendly piece of advice:

Enjoy your card as it is. Flashing and the potential trouble may be worth it when someone is mining or chasing world record, but in almost any other situation, it is not worth it.

Why i can not flash the new Bios?

As 111frodon said: Why would you want to do that?

If there are issues, RMA
If it's working fine, no need to flash unless you are willing to possibly brick it and you have money to buy a new one...

Probably because there are issues with the old firmware would be my guess, many people were having system crashes and such with the factory bios, also there's a user here who specializes in bios flashing, so asking here is the right thing to do.
