Bios for Gigabyte 7970 (GV-R797OC-3GD) slot 1

I bought a 7970 GV-R797OC-3GD, with the bios switch set to position 2 when sent (which is odd). The bios for position 1 and 2 looked like the pictures. The card is a R7970OC, not a R7970TO. Clearly bios in slot 1 is wrong. When looking at the bioses for Gigabyte 7970, there are 10 or so card with the same subsystem ID as bios 2 (1458 254D). Which is the correct one?
