It is a dick move but there's not much we can do :( consumer power hey. They're technically not lying so they can just keep on getting away with it...

I never cared much about USB 3.0 until I've tried it. I've had a 2TB WD drive and Sandisk Extreme USB and I was happy with 30MB/s. But seeing how quickly I transfer movies to HDD or that Sandisk USB drive, it's hard to go back...

It is definitely a USB 3.0 drive, but it uses a Phison PS3110-S10 controller, which shows some nice performance in benchmarks.

The only thing I'm skeptical about is longevity. Older generations of Phison 2xxx controllers would unexpectedly die or corrupt data, so when it comes to Kingston HyperX or anything Phison-based, I'd wait a year to see feedback or buy something else.
Same controller is used in Savage SSDs, so I really hope that this controller is reliable.

These USB drives are usually very expensive and I would rather buy a USB like Mushkin Ventura Ultra which has better performance and price, Ventura Ultra is practically an SSD in USB form factor.
