Well it seems I'm somewhat baffled as to why this happens. It seems after a clean format with everything installed I get this BSOD on restart or when Windows is starting up, this has happened with 2 clean installs of the OS with all patches etc. I am wondering if its the Netgear WNDA 3100 V1 USB Dual Band Wireless N Adapter Drivers I have installed (current ver is 1.7) having hiccups.
