cancel t-mobile contract

So i went to a t-mobile store and got a 2 year contract with 2 my touch phones. Here's the problems, the person only gave one of the phones and said the other phone will be ordered and come pick it up next week. no where did she mention that there was a major out of stock. So i went in after a week and she tells me there is no my touchs in Any t-mobile stores they can get currently. Even worst she says she can't guarantee that it will come in the next week. So is this enough grounds to cancel this bull?
 
Dont you get a 30day period where you can return the phones pay a prorated amount and cancel the contract without penalty? Its been a while since I worked at the major cell companies, but this was the case a couple years ago on most major carriers.

From Tmobile's Website:

4. * Cancellation and Returns. You can cancel your Service without paying an Early Termination Fee if you cancel WITHIN 14 DAYS of activating a new line of Service (30 days if you activate in California; other states may differ – ask your sales representative) (“Return Period”). You remain responsible to pay for the Service and all charges, fees and taxes incurred through the date of cancellation. To cancel during the Return Period, you must return to the store where you activated (or, if purchased online or by phone, follow the return instructions in the package), and return any Device you acquired at the time of activation.

Look up the distance selling regulations, there is a minimum of a 7 day cooling off period anything that falls into this category, including online purchases
 
get a different phone. the mytouch sucks compared to the nexus one
 
Oh i was thinking of just going back to att and getting iphones since my bro likes those alot too. The nexus could be nice cent for the price haha.
